Media Manoeuvres Privacy
Policy
Media Manoeuvres Privacy Policy is based on
the National Privacy Principles.
1.0 Collection
1.1
Media Manoeuvres will collect personal information
from individuals primarily to supply news, updates and information
on Media Manoeuvres’ products & services. Media Manoeuvres will
also collect and use personal information for other purposes,
including:
·Billing and account management
·To provide individuals with information about promotions and
media-related topics, as well as products and services of Media
Manoeuvres’ formal alliances.
1.2 Media Manoeuvres will inform individuals of the
following, before collecting any personal information:

·Our identity and contact details
2.0 Use & Disclosure
2.1 Media Manoeuvres will obtain an individual’s consent for
the use of non-sensitive information at the time of collection.
2.2 Media Manoeuvres relies on Direct Marketing and will
ensure that:
·The individual is clearly notified of their right to opt-out or
unsubscribe from further direct marketing.
·If the individual opts out of all direct marketing, the opt-out
will be respected by Media Manoeuvres, and will be included in a
“Do Not Contact List” which will be maintained and managed
in-house.
2.3 Media Manoeuvres may only disclose personal information
to unrelated third parties if consent has been obtained from the
individual, or to enable outsourcing of functions (this includes
contracted trainer/adviser, direct marketer). All contracted Media
Manoeuvres personnel must sign confidentiality agreements to
prevent the use or misuse of personal and/or sensitive
information.
2.4 Media Manoeuvres will take reasonable steps to ensure
that its contracts with third parties include requirements for
third parties to comply with the Use & Disclosure requirements
of the Privacy Act.
2.5 Media Manoeuvres will not sell or share client lists on
a commercial basis with third parties.
3.0 Information Quality
3.1
Media Manoeuvres will review, on a regular and
ongoing basis, its collection and storage practices to ensure the
personal information we collect, use or disclose is accurate,
complete and up to date.
4.0 Information Security
4.1
Media Manoeuvres requires employees and contractors
to perform their duties in a manner that is consistent with Media
Manoeuvres’ privacy policy.
4.2 Media Manoeuvres will take all reasonable steps to
ensure that paper and electronic records containing personal
information are stored in facilities that are only accessed by
Media Manoeuvres personnel who have a genuine “need to know” as
well as “right to know”.
4.3 Media Manoeuvres will review, on a regular and ongoing
basis, its information security practices to ensure that personal
information is secure.
5.0 Openness
5.1
Media Manoeuvres Privacy Officer will be the first
point of contact for inquiries about privacy issues. Individuals
wishing to make an inquiry or complaint regarding privacy, should
do so by contacting the Privacy Officer on 03 9646 3922 or

5.2 The Media Manoeuvres website will contain both a
prominently displayed privacy statement and the Media Manoeuvres
Privacy Policy.
6.0 Access and Correction
6.1
Media Manoeuvres will allow any individual to access
their personal information records upon request.
6.2 Media Manoeuvres will correct its personal information
records as soon as practically possible, at the request of the
individual concerned
6.3 Media Mannoeuvres will not charge a fee for processing a
request, unless the request is highly complex or resource
intensive.
7.0 Anonymity
7.1
Media Manoeuvres will not make it mandatory for
visitors to its websites to provide personal information, unless
such personal information is required to answer an inquiry or
provide a service. Media Manoeuvres may however request visitors to
provide personal information voluntarily to Media Manoeuvres (for
example as part of a questionnaire/survey or subscription to mail
or electronic communications).
7.2 Media Manoeuvres will allow anonymous transactions
whenever it is reasonable and practicable.
8.0 Transferring personal information
overseas
8.1
If personal information is needed to be sent by
Media Manoeuvres overseas for business reasons, Media Manoeuvres
will require the receiving overseas organisation to enter into a
binding undertaking that it will handle that information in
accordance with the National Privacy Principles, and as part of the
services contract with Media Manoeuvres.
9.0 Sensitive Information
9.1
Media Manoeuvres may only collect sensitive
information about an individual if the individual has given
consent.
10. Glossary
Direct Marketingmeans the marketing of goods or services through means of
communication, including written, verbal or electronic. The product
or service that is marketed may be those of Media Manoeuvres or
those of an independent third party organisation (for example,
special offer from a Media Manoeuvres formal business
alliance.)
Disclosure means the release of information outside Media
Manoeuvres, including a contract to carry out an “outsourced
function”.
Opt Out means an individual’s expressed request not to
receive further Direct Marketing.
Personal Information means information or an opinion,
whether true or not and whether recorded in a material form or not,
about an individual whose identity is apparent, or can be
reasonably be ascertained from the information or opinion. This can
include:
a) Non-sensitive information
·Name
·Contact Details
·Job title
·Company
·Gender
b) Sensitive information (see definition below)
Primary Purpose is the dominant or fundamental reason for
information being collected in a particular transaction.
Sensitive Information means information or opinion about the
individual concerning their:
·Racial or ethnic origin
·Political opinions
·Membership of a political association
·Religious beliefs or affiliations
·Philosophical beliefs
·Membership of a professional or trade association
·Membership of a trade or union
·Sexual preferences or practices
·Criminal record
·Health information
Media Manoeuvres Electronic Communications Policy
Media Manoeuvres Electronic Communications Policy is based on the
SPAM Act 2003.
1. Consent
1.1
Media Manoeuvres may send email communications
containing commercial messages to individuals or group of
individuals who have given consent:
1.1.1 This may be express consent from the person Media
Manoeuvres wishes to contact. Examples include:
·When the addressee has subscribed to Media Manoeuvres electronic
communications mailing list
·When the addressee has deliberately ticked a box consenting to
receive messages or advertisements from Media Manoeuvres
·When the addressee has specifically requested such material from
Media Manoeuvres over the telephone
1.1.2 It is also possible for Media Manoeuvres to infer
consent based on a business or other relationship with the person,
or their conduct. Examples include:
·When purchasing Media Manoeuvres products or services, an
addressee has provided their electronic address in the general
expectation that there will be follow-up communications.
·When an addressee has conspicuously published their electronic
address, Media Manoeuvres may send email communications to that
person if the message relates to the addressee’s published
employment function or role, unless the published address is
accompanied by the words “no spam” or a statement saying that it
should not be used for such messages.
·When a person has provided a business card containing their
electronic address, Media Manoeuvres may only send relevant email
communications (for example, if the business card was provided for
work purposes then it would be reasonable to infer that the person
consented to receiving messages which are related to their
work).
1.2 An individual may imply consent to receive Media
Manoeuvres email communications based on the status of Media
Manoeuvres relationship with her/him. Examples that might suggest
an existing business or other relationship from which Media
Manoeuvres may reasonably infer consent include:
·Persons who have purchased Media Manoeuvres products or services
which involves ongoing service provisions
·Registered users of Media Manoeuvres online services (persons who
buy Media Manoeuvres products through e-commerce - except for
one-off purchases)
·Subscribers to Media Manoeuvres information/advisory services
(newsletters)
·Employees, contractors & suppliers
·Business alliances
·Journalists targeted for media campaigns relevant to them
1.3 Where Media Manoeuvres obtains a list of contacts
through a list agency, Media Manoeuvres will take reasonable steps
to ensure consent, either expressed or inferred, has been obtained
(as outlined in item 1.1)
1.4 Where Media Manoeuvres receives a request to subscribe
someone on another person’s behalf, Media Manoeuvres will:
·Contact the addressee to confirm personal consent to commercial
email communications sent by Media Manoeuvres
·Provide information on who requested the subscription on their
behalf
·Provide information on how the subscription request was submitted
(phone, email or mail)
2. Identify
2.1
Commercial messages sent by Media Manoeuvres will
always contain clear and accurate identification of Media
Manoeuvres and our contact details.
2.2 Where Media Manoeuvres uses a third party to send a
message (for example, an email broadcast agency), the third party
will be instructed to include accurate information about Media
Manoeuvres and our contact details.
3. Unsubscribe
3.1
Media Manoeuvres will always include an unsubscribe
facility in all commercial email messages, and will process such
requests within no more than five working days from the request
date.
3.2 Requests to unsubscribe will also be accepted via
telephone, fax, postal mail or email.
3.3 Media Manoeuvres will take reasonable steps to ensure
that unsubscribed addresses are removed from our contact list
before executing email campaigns.
